Understanding our service agreement and your rights as a customer

Introduction

These Terms of Service ("Terms") govern your use of services provided by Qube Septic (Qube Construction), a septic service company operating in Idaho. By scheduling service, requesting estimates, or engaging with our services, you agree to these Terms.

1. Service Agreement

Scope of Services

Qube Septic provides the following septic services in the Treasure Valley area of Idaho:

  • Septic tank pumping and maintenance
  • Septic system installation and replacement
  • Septic system inspection and evaluation
  • Septic system repair and troubleshooting
  • Drain field installation and repair
  • Emergency septic services (24/7)

Service Estimates

Estimates provided are based on the information you provide and our initial assessment. Final costs may vary if we discover additional issues or complications during service. Any changes to the scope of work or pricing will be communicated to you for approval before proceeding.

Scheduling and Appointments

  • Service appointments are scheduled based on availability
  • We provide appointment windows (e.g., 8AM-12PM) rather than exact times
  • We'll call 30 minutes before arrival when possible
  • Emergency services may result in schedule adjustments for non-emergency appointments
  • Weather conditions may require rescheduling for safety and quality reasons

2. Customer Responsibilities

Property Access

You agree to provide:

  • Clear access to septic tank, drain field, and work areas
  • Accurate location of septic system components
  • Access to property gates, driveways, and service areas
  • Restraint of pets during service
  • Notification of underground utilities, sprinkler systems, or other hazards

Accurate Information

You are responsible for providing accurate information about:

  • System type, age, and history
  • Known problems or issues
  • Previous service or repairs
  • Property features that may affect service
  • Household size and water usage patterns

System Maintenance

After service, you agree to:

  • Follow maintenance recommendations provided
  • Avoid flushing prohibited materials (wipes, grease, chemicals)
  • Monitor system performance and report issues promptly
  • Schedule recommended maintenance at appropriate intervals

3. Payment Terms

Pricing and Fees

  • Service call fee: Charged for diagnostic visits (may be credited toward work)
  • Labor rates: Based on service complexity and time required
  • Materials: Charged at cost plus reasonable markup
  • Emergency service: After-hours and weekend rates may apply
  • Permit fees: Passed through at cost (non-refundable)

Payment Methods

We accept:

  • Cash or check (at time of service)
  • Credit/debit cards (Visa, Mastercard, Discover, American Express)
  • ACH/bank transfer for large projects

Payment Due

  • Standard services: Payment due upon completion
  • Installation projects: 50% deposit required, balance due upon completion
  • Emergency services: Payment due at time of service
  • Net 30 terms: Available for established commercial accounts only

Late Payments

Unpaid balances after 30 days may be subject to a 1.5% monthly finance charge (18% APR). Accounts more than 60 days overdue may be sent to collections. Customer is responsible for all collection costs, including reasonable attorney fees.

4. Permits and Regulatory Compliance

Permit Responsibility

For installation and major repair work, we will obtain necessary permits from the local health district. Permit fees are the customer's responsibility and are non-refundable, even if the project is cancelled.

Regulatory Compliance

All work is performed in compliance with Idaho Department of Environmental Quality (DEQ) regulations and local health district requirements. If existing systems are found to be non-compliant, we are required to report violations to the appropriate authorities.

Property Owner Responsibility

Property owners are ultimately responsible for ensuring their septic systems comply with all applicable regulations. We provide guidance and recommendations, but compliance decisions rest with the property owner.

5. Warranties and Guarantees

Workmanship Warranty

  • Installation work: 1 year warranty on labor
  • Repair work: 90 days warranty on labor
  • Parts and materials: Manufacturer warranty honored

Warranty Exclusions

Warranties do not cover:

  • Damage from homeowner modifications or misuse
  • Failure due to excessive water use or system overload
  • Damage from tree roots, ground movement, or acts of nature
  • Normal wear and tear
  • Issues caused by third-party work or modifications

6. Limitations of Liability

Service Limitations

Septic systems are complex and influenced by many factors outside our control, including soil conditions, water table levels, usage patterns, and age of components. We provide services based on industry best practices but cannot guarantee specific outcomes or system longevity.

Property Damage

We carry comprehensive insurance for property damage caused by our work. Claims must be reported within 7 days of discovery. We are not responsible for:

  • Pre-existing damage not caused by our work
  • Damage to unmarked utilities or underground features
  • Normal effects of excavation (minor settling, grade changes)
  • Landscaping restoration beyond original grade level

Limitation of Damages

Our total liability for any claim shall not exceed the amount paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages including loss of use, inconvenience, or costs incurred with other contractors.

7. Cancellation and Rescheduling

Customer Cancellations

  • 24+ hours notice: Full refund or free rescheduling
  • Same-day cancellation: 50% service call fee
  • No-show: Full service call fee charged

Qube Septic Cancellations

We may need to reschedule service due to weather, equipment issues, or emergencies. You'll receive prompt notification and priority rescheduling at no additional charge.

Project Cancellations

For installation projects, cancellations after deposit may result in forfeiture of deposit if materials have been ordered or permits filed. See Refund Policy for details.

8. Emergency Services

Availability

We offer 24/7 emergency service for septic backups, overflow situations, and urgent system failures. Emergency rates apply for after-hours service (evenings, weekends, holidays).

  • Payment due at time of service
  • Premium rates apply for after-hours service
  • We'll provide temporary solutions and follow-up recommendations
  • Additional work may require scheduling during business hours

9. Dispute Resolution

Communication First

Most issues can be resolved through direct communication. Contact us immediately if you have concerns about our service.

Escalation Process

  1. Contact the service technician or office manager
  2. Request owner/management review if unresolved
  3. Consider third-party inspection or mediation
  4. Legal action as last resort

Governing Law

These Terms are governed by the laws of the State of Idaho. Any disputes shall be resolved in the courts of Canyon County, Idaho.

10. Privacy and Data Use

We collect and store customer information to provide services, maintain records, and send service reminders. We do not sell or share your information with third parties for marketing purposes. See our Privacy Policy for details.

Service Photos and Documentation

We take photos and videos during service for documentation and quality purposes. These images are stored securely and may be used for training, but will not be shared publicly without your permission.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or posted on our website 30 days before taking effect. Continued use of our services after changes indicates acceptance of modified Terms.
